## Common questions

**Can a non-US resident form a US LLC?** Yes. No US visa, SSN, ITIN or visit is needed. Entryly needs a passport photo page and a proof of address.

**How do non-residents get an EIN?** Entryly applies to the IRS as third-party designee, so no SSN or ITIN is needed. The EIN confirmation letter (CP 575) is delivered in the customer dashboard.

**Can non-residents open Mercury Bank?** Mercury decides by the owner's country of residence. It accepts founders living in most countries but not in some (for example Pakistan, Nigeria, Bangladesh, the Philippines, Vietnam, Indonesia, Nepal, Croatia and Latvia). Each country page below says which applies.

**Can non-residents get Stripe?** A US LLC with an EIN and a US bank account can apply for a US Stripe account. Stripe reviews every application, and for founders who live where Mercury is unavailable the outcome is case by case. Stripe does not accept people in sanctioned places (for example Cuba, Iran, North Korea, Syria, Crimea).

**Do non-resident owners pay US tax?** A single-member LLC owned by a non-resident with no US trade or business usually owes no US income tax, but must file Form 5472 with a pro forma Form 1120 by April 15 every year (penalty $25,000 for missing it). Multi-member LLCs file Form 1065 by March 15. Each owner should check their own country's tax rules.

**Montana income tax?** Montana does have a state income tax. A non-resident owner with no Montana-source income usually owes none. Wyoming has no state income tax.
